Important Cost Update: Sheriffs' Retirement Fund Surcharge

The Supreme Court of Missouri issued an opinion June 1, 2021, in Daven Fowler, et al., Appellants/Cross-Respondents, vs. Missouri Sheriffs' Retirement System, Respondent/Cross-Appellant regarding the constitutional validity of section 57.955, RSMo. The Court issued a mandate June 17, 2021.

The order approving the updated COR 21.03 Schedules of Costs was issued June 29, 2021, with an effective date of July 1, 2021. These schedules reflect the change to no longer assess the Sheriffs’ Retirement Fund (SRF) surcharge of $3.00 as of July 1, 2021. All costs cards on the Court Information Center have been updated. The order applies to all circuit court and municipal ordinance divisions in the state regardless of their statewide case management system implementation status. Therefore, other case management systems in use will need to be updated to effect this change.

The statewide case management system’s docket codes, which add standard court costs, will be updated the evening of June 30, 2021. As of July 1, 2021, the SRF surcharge of $3.00 will not be assessed on new filings and new dispositions when the docket codes that add the standard court costs are used. No additional actions are needed by the clerks for new filings and new dispositions on or after July 1, 2021.

The Supreme Court order is for new assessments only. There are no appellate or Supreme Court orders regarding the collection of previously assessed or previously disbursed SRF funds. If there is a local order regarding the collection of previously assessed SRF fees, please follow the suggested procedures for monies received on or after July 1, 2021.
